Whistleblower Claims to be Heard by Jury
LAW is pleased to announce that the Court of Appeals of Georgia reversed a decision by the Superior Court of DeKalb County, which granted summary judgment in Anton I. Baptiste v. DeKalb County Sherriff Jeffrey L. Mann, in his official capacity. Anton Baptiste is represented by partners Cheryl Legare and Amelia Ragan.
In early 2014, former DeKalb County Sheriff’s Office Sergeant Anton Baptiste complained about civil rights violations and excessive use of force within the Dekalb County Jail. Baptiste also reported these violations of law and DeKalb County policy to the Office of Professional Standards and recommended they be investigated for possible criminal prosecution. In doing so, Baptiste described concerns that the Jail Division was obstructing justice by attempting to shield the violating officer from criminal indictment. Attorney’s Legare and Ragan assert that, because of these protected complaints, Mr. Baptiste was terminated after over a decade of service.
In appealing the Superior Court’s decision, LAW partners Cheryl Legare and Amelia Ragan argued that the trial court “completely omitted many of the key facts Baptiste presented,” and of the facts the trial court did consider, “many were viewed in Defendant’s favor.”
Amelia Ragan commented, “The Court of Appeals order confirms the Superior Court failed to give Mr. Baptiste the proper deference to which he was entitled and upholds Mr. Baptiste’s right to a jury trial. We look forward to representing this courageous whistleblower before that jury.”
